Terms & Conditions for repaired/serviced items

1.1 Any contract for the servicing or repair of any product shall be with TruVibe and shall be deemed to incorporate these conditions in any document or other communication used by the person requesting the servicing to be done ("the Customer"). In the event of conflict these conditions shall prevail.

1.2 No amendment or addition to these conditions shall form part of any contract unless made or specifically agreed to be by TruVibe in writing. Such amendments will entitle TruVibe to adjust the price and any delivery dates appropriately.

1.3 No Service Contract shall come into existence until the Customer's order or request for service has been accepted by TruVibe. TruVibe shall not be obliged to accept any such orders or requests.

2. Quotations/Estimates

2.1 We offer a repair service based on parts and labour. An estimate will be provided free of charge.

2.2 Quotations/estimates are issued subject to the price and availability of the necessary components required at the time of acceptance.

2.3 TruVibe  reserve the right to submit a revised estimate if:-

2.3.1 the need for additional work becomes apparent after the remedial work has commenced

2.3.2 the cost of any parts are subject to price amendment

2.3.3 work will be suspended pending the receipt of further instructions if clauses 2.3.1 or 2.3.2 become effective

2.4 When clause 2.3 applies, and the revised estimate has been refused or additional  parts are no longer available, the Customer is liable for the full payment of  the work that has been done.

2.5 Where an estimate has been provided and there has been no reply within 30 days we will assume the estimate is refused. 

3. Service and Repairs

3.1 TruVibe agrees to use all reasonable endeavors to service or repair the Product and/or to remedy any faults on it as reported by the Customer.

3.2 The time of repair is subject to availability of the parts and may take up to 30 days. If within this period the Customer decides to cancel the repair, the Customer is liable to pay the full estimate amount.

3.3 TruVibe will make every effort to keep a comprehensive stock of commonly used parts. With the increasing complexity of products and a vast overall range of spares, we are unable to stock all spares.

3.4 Spares that are not commonly used will therefore be drawn from other suppliers and TruVibe will use its best endeavors to ensure a swift delivery.  TruVibe may request an advanced payment with orders for such spares.

3.5 Any repair is subject to availability of the necessary parts.

4. Price

4.1 The Customer shall be charged for replacement parts, labour and delivery (if applicable) at the standard rates set by TruVibe from time to time.

4.2 TruVibe shall reserve the right to request a deposit against any repair which in its opinion is likely to exceed a significant proportion of the depreciated value of the Product.

4.3 The charges for all services provided (including the provision of estimates) do not include carriage/delivery charges.

4.4 The minimum charge for any repair is £20 unless agreed otherwise.

4.5 Prices are subject to alteration by TruVibe at any time without prior notice.

 

5. Collection

Should the Customer requests that the Product is to be collected from themselves and TruVibe agrees to arrange for the collection of the Product, the Customer shall be entirely responsible for the correct packaging of the Goods and TruVibe shall under no circumstances be responsible for loss or damage to the Goods due to insufficient or improper packaging nor shall TruVibe be responsible for any other consequential loss or damage whatsoever, however arising.

6. Delivery

Unless otherwise expressly stated in writing by TruVibe the Product shall be held at TruVibe's premises for collection or if requested by the Customer and agreed to by TruVibe,  TruVibe shall make an arrangement to deliver the Product to an address specified by the Customer by any method of transportation at the option of TruVibe. TruVibe will charge for delivery at the standard rate.

7. Payment

All due payments must be paid on or before delivery of the Product by TruVibe or it's collection by the Customer.

8. Uncollected Products

8.1 When the Product is ready for collection or delivery TruVibe shall contact the Customer at the address or by phone specified by the Customer. The Customer and TruVibe shall agree reasonable times during normal working hours when the Product will be collected from TruVibe's premises. If the Customer does not contact TruVibe within three months, the title to the Product shall pass to TruVibe, who shall be free to dispose of or sell the Product. If the Product is sold, the Customer is entitled to any proceeds left over once we recovered any amount owed by the Customer plus our expenses in this process.

8.2 Where the Customer was informed that the Product is beyond economical repair or where the estimate has been refused, the Customer and TruVibe shall agree shall agree reasonable times during normal working hours when the Product will be collected from TruVibe's premises. If the Product is not collected within one calendar month, the title to the Product shall pass to TruVibe, who shall be free to dispose of the Product. The Customer will be liable for any charges for such a disposal.

9. Warranty

9.1 TruVibe warrants that any repair made hereunder shall be free of defect in material and workmanship for the period of thirty days after delivery or collection of the Product to the Customer. 

9.2 This warranty does not cover any other faults not previously reported by the Customer or any new faults developed during the warranty period.

9.3 This warranty excludes wear and tear, physical damage, any damage due to incorrect use or misuse and any damage due to unauthorized repair or attempt to repair.

9.4. Spares are not subject to warranty, apart from valves, which are covered by a 5 day return policy. The item will be replaced, or the amount will be refunded, if the unit is found to be defective and has not been damaged by bad handling or fitting.
